These Terms of Use (“Terms”) govern your access to and use of the website located at www.theaustinfoundation.org (the “Site”), operated by The Austin Foundation, a Michigan 501(c)(3) non-profit organization (“The Austin Foundation,” “we,” “us,” or “our”), headquartered at 1420 Washington Blvd, Suite 301, Detroit, MI 48226.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site for lawful, personal, and non-commercial purposes consistent with our mission to empower Detroit youth. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law

  • Impersonate The Austin Foundation, its staff, volunteers, or any other person or entity

  • Attempt to gain unauthorized access to any part of the Site or its related systems

  • Transmit any harmful, offensive, harassing, or disruptive content

  • Use automated tools (bots, scrapers, crawlers) to collect data from the Site without our written permission

  • Interfere with or disrupt the integrity or performance of the Site

  • Use the Site to solicit donations or funds on behalf of any other organization or individual

2. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, program descriptions, impact data, and other materials — is owned by or licensed to The Austin Foundation and is protected by applicable copyright, trademark, and other intellectual property laws.

You may view and download content from the Site solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from the Site without our prior written consent.

The Austin Foundation name, logo, and related marks are trademarks of The Austin Foundation. Nothing in these Terms grants you any right to use our trademarks.

3. Donations

Charitable Contributions

Donations made through the Site are charitable contributions to The Austin Foundation, a 501(c)(3) organization. All donations are tax-deductible to the extent permitted by law. A donation confirmation will be sent to the email address you provide.

Designated Gifts

Unless otherwise agreed in writing, donations are unrestricted and will be used at the discretion of The Austin Foundation to advance its mission. If you wish to designate a gift for a specific program or purpose, please contact us prior to making your donation to confirm that the designation can be honored.

4. Volunteer and Program Participation

Information submitted through volunteer applications, program registrations, or event sign-ups is subject to our Privacy Policy. Participation in Austin Foundation programs and events may be subject to separate agreements, waivers, or codes of conduct provided at the time of enrollment or registration.

We reserve the right to decline volunteer applications or program participation at our discretion, particularly where the safety and well-being of our youth participants may be at stake.

The Site contains links to third-party websites and platforms, including but not limited to:

  • Linktree (linktr.ee/theaustinfoundation)

  • Substack newsletter

  • Social media platforms (Instagram, Facebook, LinkedIn, YouTube)

  • Partner organizations such as CSforDetroit, SMASH, and Kroger Community Rewards

These links are provided for your convenience. We do not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party site. Your use of third-party sites is at your own risk and subject to those sites’ own terms.

6. Shop for Impact

The Site may offer merchandise and products for purchase through our Shop for Impact section. All purchases are subject to applicable product descriptions, pricing, and any additional terms presented at checkout. If you have questions about an order or believe a transaction was made in error, please contact us at hello@theaustinfoundation.org within 14 days of purchase.

7. Disclaimer of Warranties

THE SITE AND ALL CONTENT AND SERVICES PROVIDED THROUGH IT ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE AUSTIN FOUNDATION DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE SITE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE AUSTIN FOUNDATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND VOLUNTEERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the greater of (a) the amount of any donation you made through the Site in the six months preceding the claim, or (b) one hundred dollars ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless The Austin Foundation and its officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of a third party.

10. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at www.theaustinfoundation.org to understand our practices.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on the Site with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wayne County, Michigan.
